根据移民法(SECTION 28-2-A,见内文),你可以随你老公在中国而保住你的移民身份,

你老公不需要由加拿大公司派出,但如果超过2年回加拿大时,需要由你老公带着你才能进入加拿大

28 (a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are

(i) physically present in Canada,

(ii) outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent,

(iii) outside Canada employed on a full-time basis by a Canadian business or in the public service of Canada or of a province,

(iv) outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent and who is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province, or

(v) referred to in regulations providing for other means of compliance;

      • 错, 你随加籍LG在中国才能保住身份, 反之不行.
    • 这与你的加籍LG随不随你在中国没有关系吧?问题是你在中国工作如果不是加拿大公司派过去的,你还是要满足居住年数的要求。否则,还是会失去身份。当然,你LG可以重新申请你的PR。
      • 错,跟随加籍配偶在海外行居住算加拿大居住时间
        • 但加籍配偶必须是因公派到海外才行!如果她的LG不是加拿大的公司或企业派往中国的话,她还是要满足居住条件。(记得我当初看过原文)

            • 每个人运气不一样,也看移民官的心情了。但不满足居住条件,移民官确实有权取消绿卡(虽然他也可以不取消)。
