28. (1) A permanent resident must comply with a residency obligation with respect to every five-year period.


(2) The following provisions govern the residency obligation under subsection (1):

(a) a permanent resident complies with the residency obligation with respect to a five-year period if, on each of a total of at least 730 days in that five-year period, they are

(i) physically present in Canada,

(ii) outside Canada accompanying a Canadian citizen who is their spouse or common-law partner or, in the case of a child, their parent,

(iii) outside Canada employed on a full-time basis by a Canadian business or in the public service of Canada or of a province,

(iv) outside Canada accompanying a permanent resident who is their spouse or common-law partner or, in the case of a child, their parent and who is employed on a full-time basis by a Canadian business or in the public service of Canada or of a province, or

(v) referred to in regulations providing for other means of compliance;

      According to immgration law IRPA section 28 (2) (ii), the child will maintain permanent residents status if accompanying a Canadian parent. So if you are granted Canadian citizenship and you stays with your family, each family member will maintain PR status. But take note this is true up to the time before the child reaches adult age.

      So look like you don't have to worry for at least 10 years?

          Yes, you can return to China after you become a Canadian and stay with your family/child, your spouse(husband), your kids can then maintain PR status. The drawback will be that your spouse and kid could not visit you in Canada 3 years from now. ( 2 years out of 5 year rule ).

          Anytime after 3 years, whenever your spouse wants to come to Canada, he must at least accompanied you (you are then Canadian) for 730 days to maintain his status. As for the child, I believe the rule is more relaxed ( that means the child's status is very much depend on his parent's status.)
