准确的说移民代理和律师是两个不同的概念。我贴上一段加拿大领事馆的声明,关于与代理或律师之间的纠纷的解决。请各位了解。

A representative may be a lawyer, a consultant or any other person, including a friend, whom you hire for a fee or ask to help you do any of the following at no charge: (1) apply for permanent residence or a temporary stay in Canada; (2) submit a refugee claim; (3) appear in front of an adjudicator; (4) appeal a decision; (5) apply for citizenship; or (6) request information on matters dealing with the Immigration Act or the Citizenship Act.


What you should know before seeking the services of someone to help with your application

Do you need a representative?

Citizenship and Immigration Canada (CIC) does not require you to have a representative. We have tried to make our application kits as simple as possible so that you can complete them yourself. You can get additional information on how to complete an application from the CIC Web site or from a CIC Call Centre.


If you decide to use the services of a representative, you are free to do so.


CIC treats all applicants equally and does not provide preferential service to applicants with representatives.
Who can act as a representative?

Anyone can act as a representative.


Only lawyers licensed to practise in Canada can represent you at the Federal Court.


CIC can provide information on your file only to people who are either (1) Canadian citizens, (2) permanent residents of Canada or (3) physically present in Canada. Representatives who live outside Canada and are neither Canadian citizens nor permanent residents might be unable to help you.


Volunteer and non-governmental organizations that deal with immigrants may provide free services.
General points

CIC cannot recommend representatives or vouch for their honesty or skills. It is your responsibility to make sure that the representative you choose is ethical and competent to perform the services required. You should not be afraid to ask the representative (whether a lawyer or a consultant) for references or for other proof that he or she has the necessary skills.


Beware of representatives who claim that you will get a visa, obtain citizenship or benefit from special treatment from the Canadian government by using their services. CIC is not associated with any representatives.


Be cautious when dealing with foreign-based representatives. Such companies or individuals may be outside the reach of Canadian law, and there may be no protection or remedy available in Canada to a dissatisfied client.
Lawyers

Lawyers practising in Canada are regulated by provincial regulatory bodies. Only a lawyer who is a member in good standing of a provincial or territorial law society may practise law. The law societies regulate lawyers and can investigate complaints against members, impose discipline and provide financial compensation to clients who are victims of negligence or misconduct.


If you live in Canada and you want to hire a lawyer, call the law society of the province or territory in which you live for the names of lawyers. In many cases, you can consult a lawyer free of charge for half an hour before deciding if you want to hire him or her. However, in some cases, a fee may be charged for the consultation.
Immigration consultants

Immigration consultants are not regulated by either the federal or provincial governments of Canada.


Find out if the consultant (whether he or she is in Canada or overseas) belongs to a professional association in Canada and ask about his or her experience with immigration or citizenship matters.


Call the Better Business Bureau (BBB) to find out if the consultant has a satisfactory rating. Business people who fail to respond to letters of complaint sent to the BBB receive an unsatisfactory rating.
Dealing with representatives

CIC requires your written authorization in order to release information to your representative.


You may give your own mailing address or the mailing address of your representative as a point of contact for CIC. If you choose to give your representative's address, all correspondence from CIC, including notices for interviews, requests for information, medical forms and visas, will be sent to the representative.


If you change representatives or stop using their services, you must cancel your authorization in writing to CIC or CIC will continue dealing with them. If you hire a new representative, you will have to provide a new authorization to CIC.


Make sure that the representative who helps you with your application is willing to be identified as your representative.
Information given to CIC must be truthful

Submitting false or misleading information to CIC can lead to the refusal of your application, the cancellation of your visa, the revocation of your citizenship, your deportation from Canada, and criminal charges being laid against you.


You are responsible for any documents you submit to CIC or that your representative submits on your behalf.

Where to go for help if things go wrong

CIC cannot help you if you have a dispute with your representative as it is a private matter between the two of you. However, you may write to the CIC office dealing with your case or to the following address to inform CIC of the situation:

Note: You should file a complaint with the proper authorities as soon as possible if you encounter serious difficulties with your representative as limitation periods may apply.

If your representative is a lawyer practising in Canada

Address your complaint to the law society of the province or territory where your lawyer practises. Law societies impose a code of conduct on their members to try to protect the public interest. They have rules for disciplining lawyers and compensating clients. You may be able to obtain financial compensation from the law society's insurance fund.
If your representative is a consultant practising in Canada

If your consultant is a member of a professional association in Canada, file a complaint with that association.


If your consultant is not a member of any association, you might ask the consumer protection office in your province or territory for advice. Some associations might offer to contact the consultant to seek a solution.


You can report your problem to the Better Business Bureau in the province or territory where your representative works. The BBB might contact your representative to try to resolve the issue for you.
If your representative is either a lawyer or an immigration consultant practising in Canada

If you believe your representative has committed an offense in the course of representing you, you should go to the local police or to the Royal Canadian Mounted Police.


If you are in Canada and you wish to recover money you paid for services you did not get, you can file a lawsuit in small claims court. You do not need a lawyer to do so, but you will have to pay a small fee.


Legal Aid services are available throughout Canada for people who cannot afford to pay for legal assistance. Contact them to see if you qualify for assistance.
If your representative's place of business is abroad

If your representative is not a Canadian citizen or a permanent resident of Canada, you should present your complaint to the appropriate authorities overseas. The Canadian government cannot get involved in the dispute.

    本文发表在 rolia.net 枫下论坛今年7月,在我朋友的极力推荐与怂恿下,我与本地的一家移民中介公司,签订了移民加拿大的合同,中介费为5000美金,并支付了第一笔中介费1000美金和申请费1100加币(一家三口人), 于8月中旬将所有材料准备完毕并递交香港领事馆. 可是, 后来我发现这家移民公司收我5000美金中介费是当时所有移民中介公司收费最贵的, 我问了委托这家公司办理移民的其他一些客户,他们当中有在我前面签合同的, 也有在我后面签的, 费用各不相同, 但是都比我便宜, 3000到4500美金不等, 我非常气愤, 找他们去理论, 并陪着笑脸的(强压怒火)请求他们给我便宜1000美金, 可是他们却蛮不讲理, 以我已鉴定合同和定价随行就市为由, 拒不给我降价. 到了10月底, 他们通知我让我支付第二笔3000美金中介费, 原因是我的申请档案已初审通过, 并同时收到了档案号和IETLS考试通知. 为了能跟他们把我的中介费降下来, 这第二笔中介费3000美金我就没有交, 可是他们就扣留了我的档案号, IETLS通知, 加拿大政府给我的移民申请费收据, 这样僵持了1个多月,现在仍然没有结果, 我现在非常后悔自己上了贼船, 也非常恨我那位朋友, 听说通过把我介绍给移民中介公司, 他从中提取了不少好处费, 怪不得当初他把这家移民公司说的天花乱坠, 真是知人知面不知心, 在此, 我要以我亲身经历的教训, 告诫那些正在准备申请移民的朋友们, 千万不要找移民公司为你办理, 其实他们什么工作都没有做, 所有的材料都需要你自己去准备, 他们唯一做的就是填填表格, 然后寄出去, 难道这些工作就值得你花费5000美金! 还有尤其是一些小的移民公司, 我听说没办成还有不退款的, 或者拖你个年半载, 更有甚者就是诈骗公司. 不要相信任何人, 就相信你自己, 自己动手去办理, 既省钱又能做到对每一步心中有数, 因为移民公司总是让你感到云山雾罩, 只有这样他们才能掩盖由于他们自己的错误, 而导致你移民失败或者多费几倍的时间和金钱, 同时, 我也请求各位移民前辈, 帮我想想办法, 我该怎么办才能让我的中介费降下来, 又不耽搁我的移民进程, 或者干脆终止合同( 即使赔上1000美金的预付款), 自己继续办理,但没有档案号我又怎样自己继续办理下去呢? 如果那位前辈能帮小弟出一个良策,小弟必将重谢!更多精彩文章及讨论,请光临枫下论坛 rolia.net

      要不要代理是你自己决定。

      如果你想DIY的话,办法如下:先向领馆要求UPDATE你的ADDRESS与代理人。你只要往领馆发个E-MAIL或FAX,大该三周后你一定会收到领馆寄给你的确认信。在这封信上,你只要签上名字与新邮寄地址就可以了。同时你还应附带一封亲笔信,意思大概是希望他们再向你寄一封FN与IETLS的通知书(至于理由你应会找到)。所有一切都准备好了,就用快件(EMS)邮寄至领馆。我想几周后你会收到寄来的FN与IETLS通知书的。

      那1000US你是拿不回来了,但也值,代理最主要的工作是前期的,收到FN与IETLS通知单后,他们就一点用都没有了。

      如果你是往北京送的,就当是旅游去一下大使馆,说不定当场就给你办了,省了好多时间。

      以上是我个人的看法,你还应多问问他人,特别是有经验的人。但是有一点,你别怕,他们的对你的代理权是你授权给他们的,你一取消,他们就没了。

      本文发表在 rolia.net 枫下论坛关于移民公司的问题,我的看法是,如果你自己的经济实力可以,又没有很多时间和经历去自己摸索,那不妨找一家可靠的公司。我当时找的是C&C公司,也是朋友介绍,她拿没拿钱我不清楚,跟我没关系。那时的行情是 $5900USD,对我们来说是一笔大数目了。临走时有朋友知道我交了这么多钱非常不解,按他的想法$5900可以买一 部很好的车了(的确如此)。所以他说一定自己去办,可是两年过去了,他还是没有出来,原因是他太忙了,没有人push他去继续朝前走。到现在为止,我从没有觉得当时花得钱冤枉。可以肯定地说,没有C&C的帮助,我的移民路 甚至后来工作就业融入主流社会的路会格外漫长。我觉得移民公司对我的帮助不仅仅是当二传手,帮我省了许多时间和精力,更主要的是他们帮助我从思维方式上开始改变。从开始改简历,到面试辅导,如果你留心他们的做法,就会发现他们是按照加拿大规矩来干的,而什么是加拿大规矩?我的体会就是try to make sense when you do something or deal with somebody.一种好的思维方式的形成绝对不是一朝半夕就可以做到的。但是一个良好的起步绝对是必不可少的。我 到现在仍然很欣赏他们当时为我提供的服务。正如我从来都不会忘记哪些给过我启发和帮助的朋友和师长们一样。所以尽管我知道我的这些话会被很多人责骂,我还是要为曾经启迪过我的C&C说句话。正象GORE讲的那样,Sometime you have to stand for hard right against easy easy wrong!
      但是话说回来,在找移民公司之前,你一定要搞清楚自己的期望值是什么,他们能不能满足你的愿望,然后要有对其可靠性进行调查,最后和他们谈价钱,一旦搞定了,签完了合同,就应该履行,并监督他们履行他们应该做的事。到了这时,就没必要去调查别人花了多少钱了,因为你永远不可能得到最便宜的东西,除非你什么也不买。对你的情况,我觉得你现在是属于特别急于做决定,然后心里老犯嘀估的那类人。恕我直言,你前边吃亏的日子还长着呢,如果你不能把目标集中在你的target 上边。更多精彩文章及讨论,请光临枫下论坛 rolia.net

        本文发表在 rolia.net 枫下论坛(1)首先,我很赞同你的关于及早尝试改变思维方式,以适应外国的生活和工作的的看法。尽管现在在国内,只有在一些外企中工作一段时间,你才能学到这很重要的一步。不过,学会造加拿大的规矩思维办事,是每个去加拿大长期定居的朋友迟早必须要做的一步。的确,有一部分人在那里生活了一段时间后,还未完全学会以加拿大的规矩思维

        (2)不过,这种尝试,有几种方式获得,先想办法在国内比较正规的欧美独资企业中工作几年,就是一种比较好的方法,还有想办法结识几个海外朋友,多和他们交流交流生活经验和思想,根本没有必要,也不值得通过如此深刻的教训去学习的。我认识的将近10位通过中介办移民的朋友,其中有4、5个已经在那儿生活得很好了,但一提到到当时找中介的经历,没有一个言词中不流露出后悔的意思。每一个人的经验和体会是不同的。你用比较乐观的态度去看待中介服务他们的作用,以及花$5900去办这件事(也许你是属于比较顺利的那种,还没有如此深刻的教训),这很好。我相信,如果你以相同的态度去面对今后每一件事,无论处境如何,你都会开心地生活。

        (3)生活中有几个良师益友,的确很重要。但大可不必,通过花一笔数目不菲的血汗钱去找。如果把这认为是一种服务,我相信,这里大多数朋友和我一样认为,这样的服务,与我们国内的生活水平相比,是太贵太贵了!

        (4)我也有一条人生准则,就是,世界上每一物,每一事,都有其存在的价值。找中介服务,纵观各论坛,尽管感到吃亏的人多,感到从中得益的人少,但是,有过这段经历,无论是得到教训还是学到难得的知识,都是一种经验,一种财富。你在这儿贴贴子,无非让更多的朋友share experience with you,we're very thankful for that.

        (5)“我觉得你现在是属于特别急于做决定,然后心里老犯嘀估的那类人。” Sorry, 你的判断太武断的,If I were you, I won't say such arbitrary word, because I have sufficient evidences. 不过,特别急于做决定,只是反映这个人有点quick-tempered;而心里老犯嘀估,我想,正反映了其慎重行事,三思而后行。没什么缺点呀?

        (6)C&C,我没有了解过,我无权评价。但COIBS(加拿大海外移民服务公司), 自我在各论坛贴此该贴子之后,已有3个找这家服务公司作中介的朋友(通过不同地区的COIBS办事处)反映,他们的服务质量极差。所以,可以99%做出判断,这家公司不是好公司。同时,从另外几个反映其它中介服务公司(规模比较大的公司)情况的朋友的贴子看,这几家中介服务公司服务质量也不怎么样。大多数大的中介公司都如此,你还能指望其它小公司什么呢?这种简单的以事实为根据的分析没错吧,朋友?至于C&C到底怎么样,当然也不是你在这儿贴一张帖子,就一锤定音的。我想,此早,又和你相似经历的朋友会谈谈他们的感想的。

        (7)最后,我想要说的是,每一个人,包括你,在其不同的人生阶段,吃亏是难免的,关键,一是你所说的,要有正确的人生态度;二是吃一堑长一智,从移民申请这一件事来说,鉴于质量差的公司如此之多,尽管不排除又好公司的可能,为确保起见,还是自己办为明智之举。其实,自己办的过程就是一个难得的学习过程,因为,我们出去后,一切事都要自己办,从现在做起有什么不好?更多精彩文章及讨论,请光临枫下论坛 rolia.net
        • 你说:"我们出去后,一切事都要自己办"。我想出去后,需要花钱买服务的事会更多。比如,接机、安排临时住处、学车考驾照、找职业中介帮忙找工作等等,绝大部分人还是需要花钱去买这些服务的。其实找中介办移民也是同样的道理,只是大多数人觉得不是物有所值而已。

            (1)我可没说一切服务都不要钱。关键是花钱要物尽所值,而要做到这一点,你要尽力通过各种渠道去主动了解各种情况,收集信息。不过,这些确实很花精力和时间。”作为一个过来人,曾有过相同烦恼的人,同是一个中国人,我把我的经验和教训告诉你们,只是希望你们少走弯路。

            (2)“一切事都要自己办“,我要表达的意思其实就是“你要尽力通过各种渠道去主动了解各种情况,收集信息“,其实这也是做到少吃亏的行事真谛。

            (3)各位应该知道"Apply申请"的原意是什么,“夹”,就是“把自己夹在当中“,“你要为此付出很多”的意思。我认为,如果你是准备去加拿大开创新生活的话,寄希望服务中介帮你省去很多麻烦的想法是要不得的。要期盼通过别人帮你办什么什么,这种心理一开始,就不是很正确。

            (4)我相信,出去后,需要花钱买服务的事会更多。但从这件事,我以后在花钱的时候,会更注意,尽可能了解其是否物尽所值。但化在移民中介服务的钱,in my opion, 4个字,绝对不值! 不过,你实在没信心,没把握,要把一部分成功的希望寄托在他们身上; 或者期望从这些形形色色的服务公司那儿找到一个良师益友来达到“师傅领进门”的作用,我也没办法。

                (1)在这之前,我的言词中根本就没有骂人的话,除了这张帖子,我说你的逻辑就是强盗逻辑!我坚信,大多数朋友也会这么认为的。

                (2)直到我的case结束,我事实上都是照合法途径和服务公司交涉。

                (3)中介服务因为是一种弹性很强的商品,国内现在还没有一个很规范明确的法律来约束它们的这种不很公平的商业行为,所以有相当比例的此类公司在大钻空子。一方面,你要维护遵守合同的商业道德,一方面你又一字不提这种商业行为、合同本身是否公平。你这是什么逻辑?!说的不客气一点,你不仁,我凭什么要讲义!

                (4)当时的确没人没有强迫我找中介,找上他们,我确实有主观的责任和错误。但是当时他们大登广告,开说明会,对老百姓具有极大诱惑。举个不太恰当的比喻,就好像是街头那些买劣质衬衫的流动摊贩!有一些上了年纪的老年人一时糊涂,上了当,你却站在一旁,风言风语地,叫他们只能自责,即使一头撞墙特不管,但就是反对他们以各种渠道去申述、去反映,包括向新闻媒体反映;同时对那些摊贩听之任之。你那种态度就是可怕的冷漠啊!那些流动摊贩,自有工商管理局来管他们,可那些水分甚多的中介服务呢?!很遗憾地,我看到这一块,还是真空,甚至还不如也比较混乱的方地产市场。

                    (2)我相信每一个有过类似经历的朋友,在自己的case结尾之际,都有过比较深刻的反省,毕竟这是用自己的血汗钱换来的代价。你有什么根据,说他们没有检讨过自己的错误?我也相信,他们在经历了这件事之后,今后一定会吃一堑长一智。能最后通过技术移民拿到LP的朋友,一般都是聪明人,根本不需要你来提醒他们,要先吸取教训。

                    (3)他们中的相当比例人之所以要贴出他们的经历(你所认为的“骂中介”),无非是两种原因。还在办的遇到困难,想寻求来自朋友们的帮助;过来人,想通过他们的经历来提醒后人,小心陷阱。这类贴子再怎么假,从心理分析,都不可能“恶”到什么地方去。

                    (4)如果真的要说论坛上有假,我倒首先要怀疑是否有来自中介公司的人在冒充捣鬼。为什么?很简单,从心理分析,他们是有明确而广泛的利益目的,当然要为了他们的利益而“尽一切手段”。明眼人,只要多注意看看某某人的贴子,揣摩一下他/她在keyin时的心理想法即可。我也不需要点得太破了。

                    (6)“要帮助别人,还是多讲讲当初自己找中介时的心理还好。“
                    我贴的贴子,在这方面已经讲得够详细了,我相信,能够对朋友们多少起到一点帮助作用。

                    (6)要说到“现象“,我们所看到的普遍现象是,通过中介,最后感到后悔的人远远多于满意的人。这种结论,在论坛上的各位朋友很容易就可以得出来的。可不要把这些感到后悔的人都归结为愚昧不化噢。这从中反映的问题不应该全部归结为那些中介公司的客户的责任吧?

                    btw, 我理解加拿大的律师费相当昂贵,但一家牌子听上去响当当的服务公司,服务费竟然能从US$6000跌到US$3000, 并且还增加了好几项免费服务。你难道不觉得这有点太不正常了吗?!Intel的芯片从高价到低价,有其一系列我们都看得到的合理的理由,那这些服务公司的相应理由呢?如果你还认为这不是足以质疑中介服务的充分理由,那我也无话可说了。更多精彩文章及讨论,请光临枫下论坛 rolia.net

                      我想各位朋友其实都是好心,对于找中介办理的问题发表自己的看法,希望后来的人从中吸取经验和教训。
                      我也有些朋友向我询问办移民的事,我一向的原则是建议DIY,尤其是一些经济不太富裕的朋友。但有些人坚持让我介绍中介公司,他们觉得花几万块钱办个移民没有什么不值的。我只说我是在哪家公司办的,花了多少钱,迄今为止对该公司的服务是满意的。虽然如果我带他们去签约,我可以从中介公司”拿回我的部分中介费或者换取更多服务“(中介的原话),但我还是建议他们货比三家,多了解几家公司的价格和服务。另外,我会强烈建议:如果正式签约了,就不要后悔,尤其是单方面毁约。我认为那是很没有信用的做法。
                      我自认为我的建议是很中肯的。

                        (2)我一向很注意讲话作事的严谨性,反驳也一样,这不叫钻牛角尖。钻牛角尖,是指说话和分析不全面。你认为我说话不全面吗?再回过头去看看我所贴的贴子,都是很有针对性,大多数朋友应该能体会到这一点,这可能和我学数学专业以及编程行当有关系。我除了说中介服务不太值,也说了很多涉及其它的我认为比较中肯的话和建议。而那位checkme兄曾首先说了一些偏激的话。我很奇怪,为什么你的言词明显偏袒checkme,而对我,没有一句赞同的话。这无法用你我在中介服务值不值上有分歧这一点理由来解释。heart兄也和你一样,在这一点上和我有不同意见,但他说的话相当有道理。

                            本文发表在 rolia.net 枫下论坛看来,你的申请过程确实比较顺利,所以你就不像我有那么多不满。你是什么时候办的?哪一家中介服务?要知道,对于我的case,之所以从98年拖到现在(可算坎坷),都是因为那该死的未刑和未婚公证未及时办妥(确实是我的那家中介服务公司的责任,他们说,如果办这两个公证有困难,可以暂时不办,结果半年后,移民局通过他们通知我,一定要办,不然不立案,我因为派出所没熟人,单位有规定,要办这事,必须辞职,搞得我最后不得不辞职办这件事)。因为我当时还未知结果,所以就不和他们计较,直到最后通知我LP到了,根据合同要交第三阶段的钱了,我才和他们据理力争。所以说,通过中介办的朋友,你假如确有不满,还是不要在一开始就和他们挑明,对你没好处。

                            在这漫长的等待时间,我通过互联网,结识了一大批朋友,有过来人,也有正在办的,甚至还和一个曾在一家中介服务公司工作过的谈过朋友(不好意思,已经吹了,:( ,确实像一些过来人讲的一样,要想出国,就不要考虑这事)。我也逐渐熟悉了申请的一系列流程。现在我已知道,一些能帮你办公证的中介公司(如加成)是怎么帮你办这两个该死的公证了。

                            算了,往事不堪回首,过去的就让它过去吧,就像我以前说的,不同的人,因不同的经历,感受也就大不相同。

                            我准备2月中旬和另一个朋友一起走,也到多伦多。

        我的话中和那个xyq的话中,从来都没有流露出,叫朋友们谁也别信的的意思。恰恰相反,今后到国外去生活,有很多地方,是要“出门靠朋友”的,但是处事要小心,不然,即使是朋友,有时也会出现这种吃亏的事。次数虽少,但足以让你痛苦一段时候的。

        xyq的那个朋友这样对他,当然要大骂特骂(尽管与事无补,也只能来点阿Q精神了,有时这种精神是必须的),这是人之常情。但这只是针对一个人(看清楚了?),如果把它当作什么事都没发生过,倒是有点不正常了。只是不要陷入这种痛苦的淤泥里太深,这才是最重要的。

But that is far from enough if you really want to succeed in this dynamic world. You have to learn,in stead, each and every day from every possible sources,which can be called input and in my view those kinds of input are critical when you try to learn something new to you. Immigration, as I believe, is not only a result of choice but a process of great change, during which you need to establish firm skills to meet the upcoming challenges. I doubt that for most of people they can spontaneously develop the new way of thinking. I rather believe that they need somebody to give them a few good starting input, like ones I got. If you cant get them from other sources, simply pay somebody for that kind of services. Of course it's upto you to choose and evaluate the serveice you are going to ask for . To me there is a simple truth that you dont have to do everything by yourself. You can pay for any kind of services if you want and what you need to do is just to take time to develop skills that could earn you more money and take time to enjoy your life.     • 你的代理费是可以要回的,因为移民公司是不能收取任何的中介费,如果你不怕麻烦,你可以要挟去告他们,或者翻脸给报社打电话,他们肯定会退还给你,至于你的移民申请,我认为那位春霄朋友说的不错。

          移民公司和律师事务所是两回事,大部分的移民公司根本就没有律师,所以不存在律师费,我有一个朋友就曾经一次交了2500美金给移民公司,最后因为对移民公司的不满,照样要求退回了2500美金,人家自己也办的挺顺的,没见得移民公司跟他有什么官司,关键你是不是很有钱,又能忍气,那别人也无话可说。

          A representative may be a lawyer, a consultant or any other person, including a friend, whom you hire for a fee or ask to help you do any of the following at no charge: (1) apply for permanent residence or a temporary stay in Canada; (2) submit a refugee claim; (3) appear in front of an adjudicator; (4) appeal a decision; (5) apply for citizenship; or (6) request information on matters dealing with the Immigration Act or the Citizenship Act.


          What you should know before seeking the services of someone to help with your application

          Do you need a representative?

          Citizenship and Immigration Canada (CIC) does not require you to have a representative. We have tried to make our application kits as simple as possible so that you can complete them yourself. You can get additional information on how to complete an application from the CIC Web site or from a CIC Call Centre.


          If you decide to use the services of a representative, you are free to do so.


          CIC treats all applicants equally and does not provide preferential service to applicants with representatives.
          Who can act as a representative?

          Anyone can act as a representative.


          Only lawyers licensed to practise in Canada can represent you at the Federal Court.


          CIC can provide information on your file only to people who are either (1) Canadian citizens, (2) permanent residents of Canada or (3) physically present in Canada. Representatives who live outside Canada and are neither Canadian citizens nor permanent residents might be unable to help you.


          Volunteer and non-governmental organizations that deal with immigrants may provide free services.
          General points

          CIC cannot recommend representatives or vouch for their honesty or skills. It is your responsibility to make sure that the representative you choose is ethical and competent to perform the services required. You should not be afraid to ask the representative (whether a lawyer or a consultant) for references or for other proof that he or she has the necessary skills.


          Beware of representatives who claim that you will get a visa, obtain citizenship or benefit from special treatment from the Canadian government by using their services. CIC is not associated with any representatives.


          Be cautious when dealing with foreign-based representatives. Such companies or individuals may be outside the reach of Canadian law, and there may be no protection or remedy available in Canada to a dissatisfied client.
          Lawyers

          Lawyers practising in Canada are regulated by provincial regulatory bodies. Only a lawyer who is a member in good standing of a provincial or territorial law society may practise law. The law societies regulate lawyers and can investigate complaints against members, impose discipline and provide financial compensation to clients who are victims of negligence or misconduct.


          If you live in Canada and you want to hire a lawyer, call the law society of the province or territory in which you live for the names of lawyers. In many cases, you can consult a lawyer free of charge for half an hour before deciding if you want to hire him or her. However, in some cases, a fee may be charged for the consultation.
          Immigration consultants

          Immigration consultants are not regulated by either the federal or provincial governments of Canada.


          Find out if the consultant (whether he or she is in Canada or overseas) belongs to a professional association in Canada and ask about his or her experience with immigration or citizenship matters.


          Call the Better Business Bureau (BBB) to find out if the consultant has a satisfactory rating. Business people who fail to respond to letters of complaint sent to the BBB receive an unsatisfactory rating.
          Dealing with representatives

          CIC requires your written authorization in order to release information to your representative.


          You may give your own mailing address or the mailing address of your representative as a point of contact for CIC. If you choose to give your representative's address, all correspondence from CIC, including notices for interviews, requests for information, medical forms and visas, will be sent to the representative.


          If you change representatives or stop using their services, you must cancel your authorization in writing to CIC or CIC will continue dealing with them. If you hire a new representative, you will have to provide a new authorization to CIC.


          Make sure that the representative who helps you with your application is willing to be identified as your representative.
          Information given to CIC must be truthful

          Submitting false or misleading information to CIC can lead to the refusal of your application, the cancellation of your visa, the revocation of your citizenship, your deportation from Canada, and criminal charges being laid against you.


          You are responsible for any documents you submit to CIC or that your representative submits on your behalf.

          Where to go for help if things go wrong

          CIC cannot help you if you have a dispute with your representative as it is a private matter between the two of you. However, you may write to the CIC office dealing with your case or to the following address to inform CIC of the situation:

          Citizenship and Immigration Canada
          Social Policy and Programs
          Selection Branch
          Jean Edmonds Tower North, 7th Floor
          300 Slater Street
          Ottawa, Ontario KIA 1L1

          Note: You should file a complaint with the proper authorities as soon as possible if you encounter serious difficulties with your representative as limitation periods may apply.

          If your representative is a lawyer practising in Canada

          Address your complaint to the law society of the province or territory where your lawyer practises. Law societies impose a code of conduct on their members to try to protect the public interest. They have rules for disciplining lawyers and compensating clients. You may be able to obtain financial compensation from the law society's insurance fund.
          If your representative is a consultant practising in Canada

          If your consultant is a member of a professional association in Canada, file a complaint with that association.


          If your consultant is not a member of any association, you might ask the consumer protection office in your province or territory for advice. Some associations might offer to contact the consultant to seek a solution.


          You can report your problem to the Better Business Bureau in the province or territory where your representative works. The BBB might contact your representative to try to resolve the issue for you.
          If your representative is either a lawyer or an immigration consultant practising in Canada

          If you believe your representative has committed an offense in the course of representing you, you should go to the local police or to the Royal Canadian Mounted Police.


          If you are in Canada and you wish to recover money you paid for services you did not get, you can file a lawsuit in small claims court. You do not need a lawyer to do so, but you will have to pay a small fee.


          Legal Aid services are available throughout Canada for people who cannot afford to pay for legal assistance. Contact them to see if you qualify for assistance.
          If your representative's place of business is abroad

          If your representative is not a Canadian citizen or a permanent resident of Canada, you should present your complaint to the appropriate authorities overseas. The Canadian government cannot get involved in the dispute.
